Well Simply is committed to maintaining the confidentiality, integrity, and availability of all Protected Health Information (PHI) we create, receive, maintain, or transmit. We follow the privacy and security standards established by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations, as well as applicable Texas privacy laws.
PHI includes any individually identifiable health information—such as names, dates, contact details, diagnoses, treatment information, and insurance identifiers—whether oral, written, or electronic. Our staff and providers are trained to recognize and safeguard PHI in all forms.
We use and disclose PHI only as permitted by HIPAA, including for treatment, payment, and health care operations. Other disclosures—such as those to family members, schools, or outside parties—require your written authorization, which you may revoke at any time. Certain disclosures are required by law, such as reporting suspected abuse or threats of harm.
We provide a Notice of Privacy Practices (NPP) to all clients at intake. The NPP describes how PHI may be used and disclosed and outlines your rights regarding your health information. A copy of the NPP is available upon request at any of our offices or by contacting us.
We maintain safeguards aligned with the HIPAA Security Rule, including: role-based access controls so only authorized personnel can access PHI; secure, encrypted client portal and records systems; physical security at our office locations; staff training on privacy and security; and documented policies for handling, storing, and disposing of PHI.
Any third-party vendor that creates, receives, maintains, or transmits PHI on our behalf—such as our electronic health records platform or billing services—signs a Business Associate Agreement (BAA) that legally binds them to protect your information in accordance with HIPAA.
In the event of a breach of unsecured PHI, we follow HIPAA breach notification requirements. Affected individuals will be notified without unreasonable delay, and notifications will be made to the U.S. Department of Health and Human Services and, where applicable, state authorities and media, as required by law.
Under HIPAA, you have the right to access your records, request amendments, request restrictions on disclosures, receive an accounting of disclosures, and request confidential communications. To exercise any of these rights, contact our office and we will guide you through the process.
All Well Simply team members complete HIPAA training upon hire and on an ongoing basis. We conduct regular reviews of our policies and systems to ensure continued compliance with evolving federal and state requirements.
